Terms of Agreement

1. Payment Purpose

Payment will be used solely to fund the Program. Donee reserves the right to allocate the funds in a way that complies with Scope of Activities, applicable rules and regulations, and for making payment only when students meet the Program’s eligibility criteria described in the Activity Covered and the Scope of Activities.

2. Alternative Use of Funds

In the event that a scholar selected by the Donor does not meet requirements, or there are unutilised or excess funds after deploying the funds as per rules, the Donee will seek the Donor’s preference in a written or digital media form (like email), and reserve the right to use funds to:

• Assign the funds to another deserving and eligible student.
• Carry over unspent funds to the following year and utilize in the future academic year.
• Reassign the funds to similar programs managed by the Donee through the Impactis platform, which is owned by Impactis Global Inc. and operated by itself and / or its representatives, partners, assignees or licensees, including Impactistech India Pvt. Ltd. (collectively referred here to as the “Platform”)

3. Non-Refundable Payment

Once a scholarship is published on Platform, the Payment cannot be returned and is considered non-refundable. However instances such as excess payments etc., will be refunded upon the Donor’s request.

4. Communication and Reporting

Donor is aware that he/she will be informed about the Program’s progress and the impact of payment through the Impactis Platform. This includes updates on the selection process, the recipient(s) chosen, and how the funds are being used.

5. Disclaimer

Donee makes no guarantee that a specific student will be awarded the Scholarship. The selection process is based on a set of pre-defined criteria and involves a thorough, unbiased and fair evaluation of applicants.

6. Obligations towards Platform

Donor and Donee (“Parties”) acknowledge and agree that this Donor Agreement & Funding Request has been facilitated by the Platform, and that both Parties are users of the Platform’s services. Both Parties agree to undertake communication, negotiations, or agreements through the Platform. Should they intend to continue this Scholarship without the use of the Platform, they acknowledge and agree to their individual and collective obligation to provide the Platform a three month notice.

Both Parties acknowledge the Donee and Donor may either individually or jointly, be held liable by the Platform for any damages, losses, or expenses incurred by the Platform, in the event of a breach of this clause.

7. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of India.

8. Amendment

These terms are in standard use and the Donee reserves the right to amend these terms and conditions at any time. Continued contributions received against the Donor’s Scholarship will be considered as an acceptance of the revised terms.
